It's because they are still in the midst of a divorce. A permanent agreement regarding custody of their son and soon to be daughter has not yet been reached.

I personally hope that they both get EQUAL custody of the children and the mother isn't granted full custody just because of the fact that she's the mother. Children need a father in their lives just as much as a mother, and the father of these children obviously is fighting hard to keep the children around him as much as possible.
