Doting mama Kelly Rutherford was seen leaving the set of Gossip Girl with her adorable 3-year-old son Hermés on Monday (October 26). Despite her booming career as TV’s most glamorous mom Lily Van der Woodsen, the 40-year-old single mom recently admitted to OK! that she has to work to pay the bills.
I’m a single mother with no child support. I have to work. I also happen to love what I do and think it’s a good example for kids to see their mother working. My son always says to me, ‘Mommy, why do you have to go to work?’ and I tell him, ‘I have to be able to buy the toys.’ He totally gets it.”
Kelly and estranged husband Daniel Giersch are also parents to 4-month-old Helena, who we just saw playing in the pumpkin patch with her buddy Aven Settle.
Kelly Rutherford “Constructs” Fabulous Third Birthday Party For Hermés

Gossip Girl star Kelly Rutherford threw a “construction site” birthday party for her son Hermés earlier this month.
The party, which was “Rocky the Robot Truck” themed, was held at the Alice and Olivia Showroom in New York City featured a construction site play area where the birthday boy and friends built a miniature New York City skyscraper.
Approximately 10 children and 15 adults were present, including actress Sarah Winter. Proud mom Kelly, 40, was all smiles as she told friends that Hermés wanted to do her makeup before the party. She also gushed about how much her son loves his new 4-month-old baby sister, Helena Grace, and how he gives her hugs on a regular basis.
In keeping with the construction theme, guests enjoyed tea sandwiches in the shapes of tools and ate a Rocky shaped cake.
Hermés turns three this Sunday (October 18).

Gossip Girl star Kelly Rutherford took her son Hermés, who turns 3 this month, out for a stroll along New York's Madison Avenue today.
Despite being in the midst of a "very challenging" time in her personal life - she recently obtained a restraining order against her ex Daniel Giersch - the 40-year-old mom-of-two - recently revealed that one bright spot is watching Hermes bond with his new baby sister Helena Grace, almost 4 months.
He gets up in the morning and he gives her a kiss and goes ‘tickle, tickle!’ He talks about her and how she can’t eat yet, and he’s so lucky he can have ice cream, and he can’t wait to introduce her [to it]. It’s really cute.”
Kelly Rutherford Granted Restraining Order Against Husband

Gossip Girl star Kelly Rutherford was granted a temporary restraining order Thursday (Sept. 24) against her estranged husband Daniel Giersch, PEOPLE reports.
Rutherford claims the German entrepreneur has repeatedly harassed her and her family: "[He] has begun to follow me, my mother and my nanny and he shows up unexpectedly to threaten and scare us," says the order, which is in effect for 21 days pending a court date to hear evidence.
Giersch's lawyer, Fahi Takesh Hallin, released the following statement: "Daniel will remain focused on co-parenting both of their children and not make any personal comments in order to continue to protect the children's need for privacy and well being."
The estranged couple have been battling in court over their two children: son Hermés, who turns 3 next month, and daughter Helena, 3 months. A hearing date is set for Oct. 15.
Kelly Rutherford's Custody Battle Comes To A Close

Gossip Girl star Kelly Rutherford's intense custody battle with estranged husband Daniel Giersch has finally been settled.
USMagazine.com reports that Kelly and Daniel will share joint custody of their two children, Hermes, 2, and 2-month-old baby Helena.
Kelly, who filed for divorce when she was just three months pregnant with Helena, and Daniel will relocate from California to New York while she films her hit CW show. From July 30 to April 5, she will live in New York City while Daniel will stay in the Hamptons.

The day before, Kelly was seen with her estranged husband, Daniel Giersch, and Hermés in Los Angeles. The 40-year-old Gossip Girl star, who just gave birth to their second child, Helena Grace, on June 8, made the tough decision to file for divorce from Daniel when she was just three months pregnant. Kelly recently stated that she is not afraid to raise her two children on her own:
“A lot of great men, presidents even, were raised [only] by their mother under those conditions. The most important thing is that the children have love and stability in their lives, whether that comes from a mother or a father. [Alone], I can raise them to be much more peaceful.”

Gossip Girl Kelly Rutherford, who gave birth to her second child, Helena Grace, on June 8, made the tough decision to file for divorce from husband Daniel Giersch when she was just three months pregnant. Kelly, 40, recently spoke to Life & Style about her stressful split, the cold custody battle and her plans to be a single mother.
When Kelly found out that she was pregnant again, she had hopes that a new baby might be just what they needed to save their already faltering marriage. “I found out I was pregnant, and I thought, oh, maybe things will be nice, maybe it will be calm,” says Kelly. “But it wasn’t. Things only got more intense.”
The stresses at home were only exacerbated by troubles with her husband’s job. “He was very litigious. He says he’s an entrepreneur, but I think he just sues people. It was very angry [behavior]. I was kind of scared to leave.”
A close friend of the actress, Suzannah, tells Life & Style: “[Daniel was] cold, controlling and paranoid – he threatened to ruin her career and sabotage her. He gave me the creeps, and he was beginning to get scary. We spent a lot of time trying to figure out how to get away.”
Regardless of issues with her ex-husband, Kelly is thriving as a parent and doesn’t believe that she needs a man to complete the equation: “A lot of great men, presidents even, were raised [only] by their mother under those conditions. Daniel Giersch: I Found Out About My Daughter's Birth Online

The split between new parents Kelly Rutherford and Daniel Giersch has taken another nasty turn, with Daniel accusing his ex of keeping him from the birth of their daughter.
Kelly welcomed the couple's second child on Monday, a daughter named Helena Grace. Daniel tells People magazine that though Kelly had agreed to let him know when she was in labor, in the end he learned of Helena's birth thanks to online reports.
He issued the following statement:
"Media reports claiming that I neglected to attend my daughter's birth are total lies and fabrication. I was never informed by Kelly about the birth of our daughter, nor was I invited to attend. In fact, I found out about it through Internet reports like everyone else. Although this sickens me, I am of course overjoyed that our baby was born healthy. I would've wanted nothing more than to hold our newborn daughter for a few moments, and I only seek to coparent both our children responsibly and with love."
Meanwhile, a rep for the Gossip Girl star insists that Daniel was informed as soon as possible, saying, "The doctors advised that no one be in the birthing room; [Daniel] was notified when [Helena] was born and was immediately invited to come see her."
Daniel and Kelly, who split in December after 2 years of marriage, are also parents to son Hermes, 2.
Daniel & Hermes Giersch: Strollin' In LA

Daniel Giersch was seen strolling around Los Angeles on Tuesday with his 2 ½-year-old son Hermes with a smile on his face despite the nasty divorce and custody battle he is facing with Gossip Girl ex-wife Kelly Rutherford. Rutherford and Giersch have a son and a baby girl on the way.
In January, a Los Angeles court sided with Rutherford, allowing the actress to take their son to New York City where her show is filmed, until the end of March. Giersch had strongly objected to this arrangement, stating that his home in LA would offer a more stable environment. The judge allowed the travel temporarily, and Giersch's lawyer says that a permanent custody deal will likely be agreed upon soon.
When asked how she remains upbeat despite the struggles in her personal life, the pregnant actress replied, "I'm doing so well because I know I'm making the right decision. I love my son so much and he's loved by both us – his father and I – greatly. My greatest joy in life right now is being a mom."

On whether being an eldest child prepared her for motherhood: “Yes. I took over immediately when my brother was born, ha ha! I always loved the holidays with him, and shopping with my mom. I think my mom had been told by her doctor that the best thing was to let the older sibling help, and I took it very seriously. And she always let me help with my younger brother, and that’s why we’re so close today.”
On which Gossip Girl guy she’d like Hermés to grow up to be like: “Dan. Because I think he’s smart…he has good values. He obviously has good taste in women, as he’s dating my daughter!”
On bringing her son to work: “He’s great on set. There’s so much to see. He loves the makeup and hair trailer. He’s always blow-drying everyone’s hair. There’s the little forklift that they use to build the sets—he loves to check that out. And all the trucks and brooms—he loves to sweep. There’s so much that he loves to play with.”
